Use of the www.buyfinewine.co.uk web site is on condition you agree to the terms and conditions of buyfinewine.co.uk which from time to time are subject to change and that any future use of the site will renew such an agreement.

buyfinewine.co.uk is a UK based company and any subsequent disputes or claims arising from the use of this site must be made and settled under UK law.

Order Request
When you place an order with buyfinewine.co.uk it is treated as an order request. All the wines listed on the website are subject to availability from the distribution warehouses. When you place an order request on the website, buyfinewine.co.uk contacts the warehouse to confirm availability and then arranges delivery.

To process an order request buyfinewine will perform a pre-authorization request to credit / debit card issuer. This pre-authorization confirms funds available and performs a security check on the billing address details to protect buyfinewine.co.uk against credit /debit card fraud.

A legally binding contract only exists between you the purchaser and buyfinewine.co.uk when the wine has been dispatched and the funds charged to your card.

buyfinewine.co.uk makes every effort to ensure the information listed on the website is accurate and up-to-date but there are times due to circumstances beyond our control when the vintage, description or price may change. We will always keep you informed of any changes made to your order request.

In accordance with UK law when you place an order request with buyfinewine.co.uk you warrant that you are at least 18 years of age and that you are legally capable of entering into binding contracts.

buyfinewine.co.uk reserves the right not to accept any orders and may cancel an order request up to the point of dispatch.

Pricing
All prices quoted on the buyfinewine.co.uk website include duty and V.A.T. but do not include the delivery charge. The standard delivery charge is an additional £8.75 and applies to each delivery address.

While we try and ensure that all prices on the website are accurate, errors may sometimes occur. If we discover an error in the price of the goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. All quotations whether written or verbal are treated as order requests and are subject to our terms and conditions as stated on the website.

The Mailing List
When you register for an account with buyfinewine.co.uk, you are given a tick box option of “opting out” from the mailing list. The benefits of being on the mailing list includes, the email bulletin, discounts and special offers. You can change being part of the mailing list at any time by emailing unsubscribe@buyfinewine.co.uk and you will be removed from the mailing list.

Indemnification
You agree to indemnify buyfinewine.co.uk and its related companies, affiliates, employees, agents and representatives, and to hold them harmless from all reasonable damages, losses, taxes, duties, fees, expenses, claims and liabilities (including attorneys' fees) ("Claims") that may arise from the use of buyfinewine.co.uk.

Warranties
buyfinewine.co.uk warrant that the wines will be of satisfactory quality and fit for their general purpose.

Other than as stated elsewhere within the terms and conditions of the web site, all warranties conditions, terms and undertakings, expressed or implied, whether by statute, common law, custom, trade usage, course of dealings or otherwise in respect of the goods and services provided by us hereunder and hereby excluded to the fullest extent permitted by law. Nothing in this Agreement shall affect, exclude or limit your statutory rights as a consumer.

United Kingdom Age Restriction
You must be aged 18 years old to purchase alcohol in the UK. By placing an order request you confirm you are at least 18 years old. If you are buying the wine as a gift then the recipient must be 18 years old. All goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the goods will be retained by the driver, in which case the driver will leave notification of attempted delivery. The carrier will leave a card explaining they have called and they will re-attempt to deliver the wine at the next available opportunity. If the parcel is not delivered on the second attempt, then another calling card will be left explaining the carrier has attempted a second delivery and the parcel can be collected from the local depot. If the wine is not collected from the depot within the next 2 days the goods will be returned to the warehouse and the customer will then be responsible for collecting the parcel from buyfinewine.co.uk at their own expense.

Quality and Condition
buyfinewine.co.uk is committed to providing wines that are stored correctly and from reputable sources. However there is always an element of risk in the purchase of the older fine wines as their condition is inevitably variable. Once the wine has been delivered and the statutory 7 days “cooling down” period has passed. It is then deemed to be your responsibility for the continued safe storage of the wines purchased. Wines that have been simply kept too long or mistreated will not be refunded. Incident's of “corked” wine will be resolved on an individual basis and at the discretion of buyfinewine.co.uk

If you believe a wine to be faulty please retain the liquid and contact us on 01293 734 664 or email us at service@buyfinewine.co.uk and we will be happy to make arrangements to have the wine collected and tested. Our customer service is very important to us and we will resolve each incident on an individual basis, keeping you informed throughout the whole process.

Voucher Codes
The Vouchers only apply to goods purchased on the buyfinewine.co.uk website.
The Vouchers may not be used by any buyfinewine.co.uk employee.
The Vouchers cannot be applied to past orders made with buyfinewine.co.uk and cannot be backdated or redeemed for cash.
Each Voucher code may be used only once per household at any one delivery address.
buyfinewine.co.uk reserves the right to withdraw or terminate any of its Vouchers at any time, either as a whole or for specific delivery areas. If this happens, then the Vouchers may not be used for any orders placed after the date of withdrawal or termination.
buyfinewine.co.uk reserves the right to reject the use of a Voucher where fraud is suspected.

The right to use a voucher code is personal to the intended recipient / recipients and may not be transferred. No voucher code may be copied, reproduced, distributed, or published directly or indirectly in any form. buyfinewine.co.uk voucher codes must not be stored in a data retrieval system, without the prior written permission of buyfinewine.co.uk. Voucher codes distributed or circulated without the written approval of buyfinewine.co.uk, for example on an Internet message board or on a "bargains" website, are not valid for use and will be refused or cancelled.

SEVERABILITY CLAUSE

Should any part of this Agreement be rendered or declared invalid by a court within the United Kingdom, such invalidation of such part or portion of this Agreement should not invalidate the remaining portions thereof, and they shall remain in full force and effect.

It is further agreed that if part of the Agreement is determined invalid, either party may open negotiations solely with respect to a substitute for such Article, Section, or portion, within two (2) weeks after a ruling has been made.
